The Community Law Resources Group are looking to run a class action against local governments to have local councils returned to acting as a department of a State, as opposed to a 3rd tier of government, which is what they are currently doing – completely illegally. If this class action is successful, it would mean a dramatic reduction in council rates and the elimination of council issued parking fines, un-registered dog fines and the like.

The real fraudsters are the Councillors and the CEOs who blatantly extort $3000+ from you every year.
They personally consume virtually all the $$ you pay, but Councils also receive $billions from the Federal gov/t, mostly from the fuel tax which is 38c per litre, for roadworks and rubbish collection etc.
They add that to the $$ from to your rates so they can claim they only take 20% or so for salaries.
They also know that people are waking up and that we said NO to the continuance and establishment of Local Councils as a third tier of Gov/t in 1974 and 1988 and in 1999, we rejected their Republic idea and we voted to remain a Constitutional Monarchy with the Commonwealth of Australia Constitution Act of 1901 as our National Law.
Clause 5. This Act, and all laws made by the Parliament of the Commonwealth under the Constitution, shall be binding on the courts, judges, and people of every State and of every part of the Commonwealth, notwithstanding anything in the laws of any State; that includes Councils under State “laws”
Currently, Local Councils are pushing for yet another Referendum to be recognised as a third tier of gov/t.
Question – why would they want that if they are legal?
Answer, they are not – they fear for their fat salaries and perks.
Question – who will paint the swings in the local park and playgrounds? …
Answer there are heaps of charitable people in every community.
Question … who will maintain the town hall? Answer – most halls in most towns were built by voluntary effort … the residents own the hall, not the council.
1. All Parliaments require authority from somewhere to make Laws.
2. Where does the Western Australian Parliament receive its authority from?
3. Answer; the Western Australian Constitution s57 and the Commonwealth Constitution s108.
4. The Western Australian Constitution is subject to the Commonwealth Constitution s106.
5. Local Government relies on the Local Government Act 1995 (WA) for its existence.
6. The Local Government Act 1995 (WA) relies on s52 of the Western Australian Constitution for its existence.
7. Municipal institutions and local government is in the Commonwealth Constitution as a department of a State Government. (Pages 935 & 936 Annotated Constitution).
8. In 1979, The Parliament of Western Australian created the Western Australian Constitution to include s52 which inserts Local Government into the Western Australian Constitution.
Some questions.
1. Can the Parliament of Western Australian amend the Commonwealth Constitution? NO. Only the people of the Commonwealth can do that by means of s28 (referendum) of such Constitution.
2. Can the Parliament of Western Australian create any Laws that are inconsistent with the Commonwealth Constitution? NO. s106 & s108 Commonwealth Constitution.
